EB-2 NIW Requirements: The Dhanasar Framework
USCIS evaluates every EB-2 NIW petition against the three-prong Matter of Dhanasar (AAO Dec. 27, 2016) standard. You must satisfy all three prongs.

Substantial merit and national importance
Your proposed endeavor must have inherent value to a field (STEM, arts, business, healthcare, law, etc.) and the national impact must extend beyond your immediate employer or locality. Evidence: prior achievements, publications, grants, letters from field experts, economic or social impact statements.

Well positioned to advance the endeavor
You must show you specifically have the education, skills, knowledge, and track record to move the work forward. Evidence: degrees, citations, patents, prior results, institutional support, collaborators, letters from recognized authorities.

On balance, beneficial to waive the job offer requirement
USCIS weighs whether requiring a labor certification and employer sponsor would impede advancement of the national interest. Self-petitioners show urgency, unique position, or that the benefit to the U.S. outweighs the general protections of the labor certification process.
Who Qualifies for EB-2 NIW?
Before applying the Dhanasar test, you must first qualify under EB-2 itself — either as an advanced degree professional or as a person of exceptional ability.
- U.S. master's degree or foreign equivalent; OR
- U.S. bachelor's + 5 years progressive work experience
- Degree must be in the field of the proposed endeavor
- Degree from college/university relating to area of exceptional ability
- 10+ years full-time experience in occupation, OR
- License to practice your profession, OR
- High salary relative to others in field, OR
- Membership in professional associations, OR
- Recognition for achievements by peers, government, or professional organizations
Note: EB-2 NIW does not require a job offer or employer sponsor — you file Form I-140 as a self-petitioner directly with USCIS. Compare with EB-1A, which also allows self-petition but carries a higher evidentiary bar.
