Frequently Asked Questions

How is the readiness score calculated?
The score uses a weighted algorithm across five factors: eligibility completeness (40%) — do you meet the core legal requirements; evidence strength (25%) — how much supporting evidence you have assembled; service center performance (15%) — how your target SC performs historically for your visa type; profile risk (10%) — prior denials, RFEs, employment gaps; and documentation completeness (10%) — forms, fees, and supporting documents. Each factor is scored 0–100 and combined into your overall readiness score.
What's the difference between NSC and TSC for H-1B?
Based on FY2024 USCIS data: Nebraska Service Center (NSC) has approximately a 91% H-1B approval rate with a 23% RFE rate and ~105 day average processing. Texas Service Center (TSC) has approximately an 88% approval rate with a 30% RFE rate and ~120 day processing. NSC is generally preferred for H-1B petitions where employer location allows a choice. California SC (CSC) has the highest RFE rate (~33%) among major service centers. Note: USCIS typically assigns service centers based on employer location, so you may not always have a choice.
What score do I need to be "ready to file"?
A score of 70+ (green, "Strong" or "Likely Ready") generally indicates you have the fundamentals in place. A score of 45–69 (amber, "Needs Work") means significant gaps exist that should be addressed before filing — these are likely to generate an RFE. A score below 45 (red, "Not Ready") indicates critical eligibility or evidence issues. Review all critical items and consult with a licensed immigration attorney before proceeding.
Is this legal advice?
No. This tool provides educational information and analysis based on publicly available USCIS data and general eligibility frameworks. It is not legal advice and should not be relied upon as a substitute for consultation with a licensed immigration attorney. USCIS adjudications are highly fact-specific. USVisaStack makes no representations or guarantees regarding immigration outcomes.
Can I use this for EB-2 NIW or EB-5?
Yes. The readiness scorer supports H-1B, O-1, L-1A, L-1B, E-2, EB-2 NIW, EB-1A, EB-5, F-1 OPT/STEM, and TN. Each visa type has a customized eligibility criteria checklist, evidence inventory, and documentation checklist. The service center intelligence (approval/RFE/denial rates) reflects FY2024 USCIS data specific to each visa type and service center combination.
How current is the service center data?
Service center performance data is based on FY2024 USCIS Adjudications Statistics (published 2025). Processing time estimates reflect USCIS published data as of March 2026. Note: service center performance can shift due to policy changes, staffing, and filing volume. The paid full report includes the most current data available in our system.
