How to Choose: EB-5 vs EB-2 NIW
EB-5 and EB-2 NIW are both pathways that allow a form of immigration independence — EB-5 through investment without an employer, and EB-2 NIW through self-petition without an employer for professionals whose work has national importance. They serve very different applicant profiles. EB-5 is for investors: you need $800,000–$1,050,000 of qualifying investment capital, creation of 10 US jobs, and the legal framework of either a direct investment enterprise or a USCIS-designated Regional Center. EB-2 NIW is for professionals with an advanced degree or exceptional ability in their field who can demonstrate their work has "substantial merit and national importance" (per the Dhanasar standard). EB-2 NIW does not require investment capital. EB-5 has its own per-country backlogs (most significant for China). EB-2 NIW is accessible to any nationality based on professional merit. For researchers, academics, physicians, engineers, and entrepreneurs with strong credentials, EB-2 NIW is typically more accessible than EB-5 and doesn't require investment capital.
