How to Choose: EB-3 vs TN
EB-3 and TN represent very different strategic choices. TN is a nonimmigrant work visa for Canadian and Mexican USMCA professionals offering immediate, simple work authorization with no cap and no lottery, but no direct path to a green card and no dual intent. EB-3 is an immigrant visa — an employment-based green card requiring PERM labor certification, employer sponsorship, and typically 2–4+ years of processing. The choice depends entirely on your long-term goal: if you want permanent US residence, EB-3 (or another employment-based category) is necessary. If you want to work in the US temporarily or are unsure about permanent residence, TN is dramatically simpler. Some Canadian and Mexican professionals use TN for initial work authorization, then separately begin the EB-3 process once they decide to pursue permanent residence. Note that aggressive pursuit of a green card while on TN can technically create dual intent issues — consulting an attorney about the timing is advisable.
