How to Choose: EB-1 vs EB-2
EB-1 and EB-2 are both employment-based preference green card categories, but they differ significantly in requirements, eligibility for self-petition, and processing speed. EB-1 has three subcategories: EB-1A (Extraordinary Ability, self-petition), EB-1B (Outstanding Researchers and Professors, requires employer), and EB-1C (Multinational Managers, requires employer). EB-2 also has three subcategories: employer-sponsored with PERM labor certification, Advanced Degree, and EB-2 NIW (National Interest Waiver, self-petition). The critical advantage of EB-1 over EB-2 for Indian and Chinese nationals is the priority date: EB-1 is closer to current (shorter backlog) than EB-2, though both face significant waits for high-demand nationalities. For other nationalities, both categories typically process in 2–4 years.
